HYDE PARK BIA Contest Rules
By entering a Hyde Park BIA Contest, you agree to be bound by the outlined Contest Rules. These rules pertain to all contests managed by Hyde Park BIA in Canada, both electronically and through printed copies, including on the Hyde Park BIA Website: https://hydeparkbia.ca, and places which include Hyde Park BIA promotions via Facebook, Instagram, Twitter, or any other Third Party Services or sites (“Contest Parties”). Exceptions lie where there are outlined rules for a Hyde Park BIA Contest indicated elsewhere. To participate for a chance to win a Hyde Park BIA Contest, follow the directions given on the Website, via the Third-Party Service, or by the on-air host (as applicable).
As appropriate, for each Hyde Park BIA Contest, specifics of the prize(s) available to be won, the start and end dates and/or times, and any other material pertinent to participating and/or winning will be announced on the Website, via the Third Party Service, and/or by the on-air host.
Each Hyde Park BIA Contest has a limit of one entry per person per day, unless otherwise stated. Contests are open to all Canadian residents who have reached the age of majority in their province or territory of residence. For any contestant who has not reached the age of majority, parental or guardian consent is necessary to enter a Hyde Park BIA Contest. The terms “contestant” and “winner” may refer to the parent or guardian of an underage individual, where appropriate.
Employees of Hyde Park BIA, such employees’ immediate family or persons living at same address are not eligible to enter any Hyde Park BIA Contest. A Hyde Park BIA delegate will indicate all qualifying entries made by the contest deadline. Selected contestant(s) will be contacted using the information from their time of entry such as (but not limited to): telephone number, email address, Instagram, Twitter, and/or Facebook account. If a chosen participant cannot be reached or qualified using the information provided at the time of entry within three business days, or declines the prize, or fails to return any required release form, the prize shall be surrendered, unless otherwise stated on the Website, or via Third-Party Service, or by on-air host. As such, Hyde Park BIA has the right to select another winner at its decision. For Hyde Park BIA Contests where the winner is accountable for picking up the prize, the prize must be picked up within 30 days or it shall be forfeited. Hyde Park BIA has the right, at its sole discretion, to select another winner.
Winners will be required to provide proof of identification. Winner(s) may also be required to complete a mathematical skill-testing question, and/or to sign a release stating their eligibility as outlined in these rules. By signing, the selected contestant will release Hyde Park BIA, any sponsors or prize donors and their directors, officers and Third-Party Services (all Contest Parties) from all liability for any damage or loss arising from partaking in the contest from accepting the prize, or the use of the prize henceforth.
Prizes shall be received as is and may not be replaced, refunded, sold or transferred. No substitutions will be permitted. If any portion goes unused it shall be forfeited to Hyde Park BIA.
If the prize cannot be awarded as described in these rules, Hyde Park BIA has the right to decide, at its sole discretion, to replace a prize or component with another of similar value. Refusal to accept the prize releases the Contest Parties from any obligation toward the winner. If a contestant makes any false statement, they will be automatically disqualified from the Contest. Winners agree that for free of charge, Hyde Park BIA may use their name, image and/or voice for advertising purposes related to a Hyde Park BIA Contest.
The Contest Parties accept no liability for: any loss, damage or injury, including without limitation: (i) lost, stolen, delayed, damaged, misdirected, late, destroyed, illegible or incomplete entries; (ii) loss, theft or damage to software or computer or telephone data, including any breach of privacy; (iii) fraudulent calls; (iv) inability of any person to participate in the Contest for any reason including mistaken addresses on mail or e-mail; technical, computer or telephone malfunctions or other problems with computer on-line systems, servers, access providers, computer equipment, or software; congestion on the internet or at any website, or any combination of the foregoing; (v) damage to any person’s computer, including as a result of playing or downloading any material relating to the Contest; (vi) any delay or inability to act resulting from an event or situation beyond their control, including a strike, lockout or other labour dispute at their location or the locations of the organizations and businesses whose services are used to administer the Hyde Park BIA Contest; (vii) any injury, damage or loss arising from participation in the Hyde Park BIA contest or from the awarding, acceptance or use of any prize, or (viii) prizes that are lost, damaged or misdirected during shipping.
Hyde Park BIA reserves the right to cancel, suspend, reschedule, or abandon the Hyde Park BIA Contest should a cause beyond their reasonable control corrupts the security or proper administration of the Hyde Park BIA Contest. Any endeavor to intentionally damage any website or to undermine the legitimate operation of the Hyde Park BIA Contest is a violation of criminal and civil laws. Should such an attempt be made, Hyde Park BIA reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
If the identity of a participant is questioned, the authorized account holder of the e-mail address submitted at the time of entry will be recognized as the contestant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected contestant may be required to provide proof that they are the authorized account holder of the e-mail address associated with the selected entry.
All entries using e-mail addresses must be submitted from a valid e-mail account that may be determined by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in the Hyde Park BIA Contest will be the Contest server.
The decisions of Hyde Park BIA with respect to any dispute or issue involving a Hyde Park BIA Contest are final and binding on all contestants. Hyde Park BIA reserves the right to amend the Contest Rules or to end any Hyde Park BIA Contest at any time and does not claim any liability or obligation for participating contestants.
